NT Lakis attorneys have confirmed with senior officials in the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) that the agency has ended its longstanding practice of mailing so-called advance notice letters, formally known as “corporate scheduling announcement letters” (CSALs), to federal contractor establishments that have been selected, but not yet scheduled, for a compliance audit. Instead, contractors will find out if they have been targeted for an audit when OFCCP publishes the first new audit list for Fiscal Year (FY) 2019, which should be soon.
The OFCCP officials also advised us that the forthcoming audit list for the first time will include and identify establishments that have been selected for a “focused review.” The officials indicated that OFCCP intends to issue guidance for federal contractors on the agency’s new focused review process in the near future, and that the audit list will be posted shortly thereafter.
