Over the last several weeks, there has been significant, albeit not determinative, movement in three high-profile lawsuits filed by the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) against Google, Convergys, and Oracle, respectively.  

Given that there has been some confusion in media accounts regarding the status of each case, we prepared a guide describing what has (or hasn’t) happened in the underlying cases and the significance of these developments for employers.

As a threshold matter, please note that there has not been a merits determination by a Labor Department Administrative Law Judge (ALJ) or any other adjudicator in any of the three cases. Thus, as a practical matter, the underlying disputes are yet to be decided and, barring settlement, the three cases are expected to continue along for the foreseeable future.
