Factoring in a new batch of nine financial settlements, reported below, that have been posted by the agency since our last update a few weeks ago, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has now collected over $11 million in back pay and interest for over 38,000 individuals during the current fiscal year.
Included in this latest round is another Early Resolution Conciliation Agreement (ERCA), referred to here by the parties as a “global” Conciliation Agreement (CA), as well as a formal consent decree settling an administrative enforcement action brought by the Solicitor of Labor on behalf of OFCCP against TIAA. The remaining seven settlements all involve standard CAs stemming from OFCCP compliance audits.
Five of the settlements were for alleged hiring discrimination violations, three (including the TIAA consent decree) for compensation discrimination, and one for both hiring and compensation discrimination violations.
