As we approach the end of President Biden’s first year in office, we thought this would be a good time to update employers on the status of the President’s appointments to key positions within the various federal agencies that regulate the workplace.
Many of these appointments require confirmation by the U.S. Senate, and because of ongoing partisan wrangling, the confirmation process has turned out to be unusually time consuming and arduous this past year. As a result, and despite the fact that it’s been almost a full year since the Biden Administration assumed office, there still are a number of key appointive positions that are unfilled at the Department of Labor (DOL), the Equal Employment Opportunity Commission (EEOC), and other agencies responsible for workplace policy and enforcement.
This personnel update focuses primarily on key positions that require Senate confirmation, although we also include a few important appointed positions such as the Director of the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) that did not have to be confirmed by the Senate.
