A national food manufacturer that did not timely submit its 2024 and 2025 California pay data reports will pay a $142,800 settlement, the California Civil Rights Department announced October 21. The settlement demonstrates that filing a California pay report after the deadline can prompt a CRD enforcement action even if an employer ultimately cures the omission.
The settlement includes an agreement between the parties that any future missed pay reporting deadline will be treated as another failure under California Government Code section 12999 and will carry increased penalties.
Covered employers should calendar the second Wednesday in May as a firm annual deadline and begin collecting payroll, demographic, hours-worked, and labor-contractor data well in advance. They should confirm that labor contractors will provide complete reports on time — including reports that incorporate the 23 Standard Occupational Classification (SOC) major occupational groups rather than the 10 EEO-1 job categories previously used. Employers that discover a missed or incomplete report should take corrective action promptly rather than waiting for CRD outreach.
