The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, has developed a resource to help its members understand their obligations under state laws to respond to surveys conducted by the federal Bureau of Labor Statistics (BLS).
BLS collects and publishes information about the U.S. labor market and economy. In collaboration with the states, BLS sends out requests for employers to participate in four reports: Annual Refiling Survey, Current Employment Statistics Survey, Multiple Worksite Report, and Occupational Employment and Wage Statistics Report. These reports ask employers to provide information about wages, job titles, and locations. While there is no federal requirement that employers participate in these data and information requests, some states require employers to participate.
The resource summarizes relevant state laws that mandate participation and the state penalties that employers could face for failing to respond.
