The Equal Employment Opportunity Commission (EEOC) has posted an announcement on the EEO-1 Homepage informing covered employers that they will no longer be permitted to utilize “Type 6” establishment records during the upcoming filing period for the 2021 “Component 1” Employer Information (EEO-1) Reports. The agency’s action therefore ends the EEOC’s historical practice of allowing EEO-1 filers to file what is known as a “Type 6” establishment list, showing the name, address, and total headcount for small establishments, rather than filing a separate EEO-1 report for any establishment employing fewer than 50 employees.

According to the attached fact sheet posted by the EEOC in conjunction with its announcement, elimination of the Type 6 report “will allow the EEOC to collect more accurate employee demographic data in support of the agency’s mission to prevent and remedy unlawful employment discrimination and advance equal opportunity for all in the workplace.” Thus, beginning with the 2021 filing cycle, “Type 6” employers (i.e., those with establishments employing fewer than 50 employees) will now need to file individual reports – known as “Type 8” records – for each of those establishments.
