EEOC’s final Strategic Plan for FY 2026-2030 includes a notable revision to the agency’s systemic enforcement performance measure but otherwise is largely unchanged from the draft released earlier this year. The final plan retains performance measures addressing enforcement, outreach and training, and agency operations.
Regarding the systemic enforcement revision, the draft would have measured success partly by whether the EEOC obtained at least $1 million in monetary relief in 80% of systemic investigations where it found cause. The final plan eliminates that benchmark and instead focuses on resolving complex systemic matters while obtaining meaningful equitable and monetary relief.
Although strategic plans function primarily as management documents, the performance measures they contain can influence the EEOC’s allocation of resources and evaluation of success. The final plan continues to emphasize investigation quality, systemic enforcement, and improvements to the charge-intake process.
In comments on the draft, CWC expressed concern that the proposed $1 million systemic-relief benchmark could create unintended incentives and urged the EEOC to focus on appropriate remedies rather than a particular dollar amount. The revised measure appears to focus more appropriately on meaningful outcomes.
