Coinciding with the one-year anniversary of the Supreme Court’s decision in Bostock v. Clayton County, the landmark ruling holding that Title VII of the Civil Rights Act of 1964 prohibits discrimination based on sexual orientation and gender identity, the Equal Employment Opportunity Commission (EEOC or Commission) has published new guidance and other materials related to sexual orientation and gender identity discrimination.

The new guidance, which was cleared by EEOC Chair Charlotte Burrows without a vote of approval by the agency’s other Commissioners, is generally consistent with prior positions taken by the EEOC. At the same time, however, the new guidance has been criticized by a majority of the other Commissioners for going beyond the bounds of Bostock.
