Shortly after he assumed office, in an unprecedented and highly controversial move, President Biden fired the General Counsel (GC) of the National Labor Relations Board (NLRB), Peter Robb, even though Robb had 10 months left on his statutorily set term.
Then last week, again in an unprecedented and equally controversial move, the President fired Sharon Fast Gustafson, the General Counsel of the Equal Employment Opportunity Commission (EEOC), even though her statutorily set term was not scheduled to expire until August of 2023. Both Robb and Gustafson were Trump appointees, and both were vigorously opposed by employee advocacy groups closely aligned with the new Biden Administration.
The immediate impact of Gustafson’s termination is that for the foreseeable future the EEOC’s litigation program will now be run by career officials, who are likely to adhere to the priorities established by Democratic EEOC Chair Charlotte Burrows.
