The incoming Biden Administration has moved with impressive swiftness to fill dozens of key employment policy roles which don’t require U.S. Senate confirmation in the Department of Labor (DOL) and other federal agencies responsible for regulating the workforce. Among the most notable examples is the immediate appointment of former Equal Employment Opportunity Commission (EEOC) Chair Jenny Yang as Director of DOL’s Office of Federal Contract Compliance Programs (OFCCP).

Although it will take considerably more time for the Administration to install agency leaders whose appointments require confirmation by the U.S. Senate, such as Marty Walsh, who has been nominated to be the next Secretary of Labor, filling many of these other senior policy positions will enable the Biden Administration to begin implementing major policy changes right away. Perhaps not surprisingly, very few of these newly appointed individuals have business backgrounds
