President Trump has signed new Executive Order (E.O.) 13950 (September 22, 2020), that among other things prohibits federal contractors and subcontractors from conducting workplace training programs that include race or sex “stereotyping or scapegoating.”

The E.O., which applies to any federal contractor after it enters into a new (and likely a renewed or modified) contract on or after November 21, 2020, will require the contractor to carefully review any workplace training, especially training related to nondiscrimination, diversity, and inclusion throughout its entire organization. Penalties for noncompliance include contract debarment.

In addition to barring certain training, the E.O. instructs the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) to issue a “Request for Information” within 30 days that directs the agency to seek from contractors copies of materials relating to diversity and inclusion as well as information about the duration, frequency, and expense of such activities.
