NT Lakis lawyers have filed written comments with the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) in support of the agency’s proposal to give up jurisdiction over certain entities that provide supplies or services to participants in TRICARE, the health care program for veterans and their families run by the Department of Defense (DoD). The proposed rule, which we observe is consistent with Congressional intent, is designed to resolve once and for all a dispute about whether OFCCP has authority over such providers.
Our comments commend OFCCP for finally acknowledging that bipartisan legislation enacted years ago took away the agency’s claimed authority over those entities that provide supplies or services to TRICARE participants. We also support OFCCP’s contention that the proposed rule would benefit the nation’s veterans by removing a significant barrier to providers’ participation in TRICARE: OFCCP compliance costs.
