The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) has received the go-ahead from the White House Office of Management and Budget (OMB) to begin using a new, “supplemental” desk audit Scheduling Letter. More specifically, the new letter will be used to initiate a “focused compliance review” of a federal contractor’s disability affirmative action program (AAP) developed pursuant to Section 503 of the Rehabilitation Act (Section 503) and new OFCCP Directive 2018-04.

The new Section 503 Focused Review Letter is essentially an abridged version of OFCCP’s standard desk audit Scheduling Letter and Itemized Listing, which OFCCP currently sends to all federal contractor establishments flagged for a compliance evaluation. The data and information requested by the new focused review scheduling letter concentrate primarily, but not exclusively, on Section 503 items that are already part of OFCCP’s standard scheduling letter.

Please note that federal contractor establishments scheduled for a compliance evaluation as part of OFCCP’s recently released supplement to the fiscal year (FY) 2018 scheduling list will not be subject to a Section 503 focused review. Rather, Section 503 focused reviews will be selected from a FY 2019 scheduling list that has not yet been released.
