President Biden will nominate current Deputy Labor Secretary Julie Su to be the next Labor Secretary, replacing Marty Walsh, who has departed to take a position with the National Hockey League Players’ Association. Although Ms. Su’s nomination will require confirmation by the U.S. Senate—which is not a slam dunk given some controversy surrounding her tenure as California’s Labor Commissioner—she will serve as Acting Secretary for the time being. Ms. Su generally is viewed as more of a regulator than Mr. Walsh, a former union official whose tenure at DOL focused primarily on promoting the President’s agenda around the country and advancing the interests of organized labor. Ms. Su is expected to put more emphasis on worksite enforcement by DOL agencies such as the Office of Federal Contract Compliance Programs (OFCCP) and the Wage and Hour Division (WHD).
