During its recently concluded term, the U.S. Supreme Court decided several important cases addressing religious liberties, one of which relates specifically to employment discrimination. While these decisions collectively do not have any direct impact on most private sector employers, they can be generally characterized as expanding the protection afforded to individuals and religious institutions to practice their religious beliefs without government interference. As such, they open the door to the possibility that the current majority on the Court may be receptive to considering future cases that revisit the standard for reasonably accommodating an individual’s religious beliefs and practices under Title VII, a point raised by three of the sitting Justices in a case that the Court ultimately decided not to review.
