The Trump Administration has issued a report entitled Delivering Government Solutions in the 21st Century: Reform Plan and Reorganization Recommendations, calling for a reorganization of the federal government’s Executive Branch. The new report, released on June 21, 2018, was prepared in response to an Executive Order signed by the President in March 2017 directing Executive Branch agencies to submit their recommendations for reforming the government to the White House Office of Management and Budget (OMB).

Of particular interest to employers, the Report proposes merging most components of the Labor Department (DOL), including the Office of Federal Contract Compliance Programs (OFCCP) and Wage and Hour Division (WHD), with the U.S. Department of Education (ED) into a new agency to be called the Department of Education and the Workforce.

Because major components of the reorganization plan – including the DOL-ED merger – would require Congressional approval, there is virtually no chance that Congress will do anything this year. Moreover, absent a significant change in the current political climate, the longer-term prospects that Congress will act favorably on any of the Report’s recommendations are iffy at best.
