The Office of Federal Contract Compliance Programs has asked the Office of Management and Budget to let it revise its complaint and pre-complaint inquiry forms. OFCCP uses its Complaint of Employment Discrimination Involving a Federal Contractor or Subcontractor (Form CC-4) and Pre-Complaint Inquiry for Employment Discrimination Involving a Federal Contractor or Subcontractor (Form CC-390) to process employment discrimination allegations against federal contractors.

OMB approved similar revisions to the forms on an emergency basis in July 2025. OFCCP’s formal request is the final step in the process mandated by the Paperwork Reduction Act. The changes reflect the rescission of E.O. 11246 and confirm that individuals may no longer file discrimination complaints with OFCCP based on race, color, religion, sex, sexual orientation, gender identity, or national origin, or allege that they were retaliated against for asking about, discussing, or disclosing compensation.

The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, plans to submit comments to OMB by February 2. OFCCP’s proposed changes to the complaint forms will be featured at CWC’s virtual Workplace Policy Conference, which will be held March 18-19.
