As expected, “Guidance” issued late last week by the Safer Federal Workforce Task Force to implement President Biden’s Executive Order (E.O.) 14042, Executive Order on Ensuring Adequate COVID Safety Protocols for Federal Contractors, calls for all “covered contractor employees” to be fully vaccinated by Wednesday, December 8, 2021, or by the first day of performance on the contract, whichever is later. The Task Force also calls for covered contractors to follow guidance from the Centers for Disease Control and Prevention (CDC) on the use of masks, including requiring all individuals, regardless of vaccination status, to wear masks indoors in areas of high or substantial community transmission.

The Guidance applies only to those federal contractors and subcontractors that enter into a covered federal contract on or after November 14, 2021. Employers with covered contracts awarded prior to October 15, 2021, will not be subject to the Guidance until an option is exercised or the contract is extended.
