Coming as no surprise, the Biden Administration’s Department of Labor (DOL) has announced the immediate end to the “Payroll Audit Independent Determination (PAID) Program.” The PAID Program was a voluntary program put in place by the Trump DOL that allowed a participating employer to give back pay to employees if the employer discovered that it had inadvertently violated the Fair Labor Standards Act (FLSA).
Under the PAID program, a participating employer was able to use the DOL-supervised settlement process to resolve FLSA violations without potential liability for liquidated damages if litigation ensued.
