The Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) is asking for formal approval to begin using two new “focused review” desk audit Scheduling Letters, one for promotion practices under Executive Order 11246, and the other for disability accommodations practices under Section 503 of the Rehabilitation Act and religious accommodations practices under E.O. 11246. The agency signaled its intent to begin conducting these new types of audits with the release last September of its annual Corporate Scheduling Announcement Lists (CSALs).
The proposed new Scheduling Letters, which must be approved by the White House Office of Management and Budget (OMB), are essentially abridged versions of OFCCP’s standard desk audit Scheduling Letter and Itemized Listing. More specifically, the data and information requested by the new Scheduling Letters concentrate primarily, but not exclusively, on items that are pertinent to either a federal contractor’s promotions or accommodation practices. It’s worth noting, however, that the proposed accommodations letter retains the standard scheduling letter’s request for detailed race and gender data pertaining to affirmative action goal progress, employment activity, and compensation.
