The Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) has announced that covered federal contractors that use the Census Bureau’s “EEO Tabulation,” also referred to as the “EEO Special File,” in their affirmative action program availability estimates must begin using the new “2014-2018 EEO Tabulation” for plan years beginning on or after January 1, 2022. OFCCP uses the EEO Tabulation data as a means to assess the accuracy of a contractor’s AAP availability calculations during a compliance evaluation.

As we reported earlier this year, the 2014-2018 EEO Tabulation, which supersedes the 2006-2010 Tabulation, contains detailed occupational data tables that many companies use to develop labor market availability estimates for their corporate equal employment opportunity, affirmative action, and diversity and compliance programs. Federal contractors subject to OFCCP’s affirmative action regulations typically use the tabulation as the primary data source to calculate external availability estimates for their annual affirmative action programs (AAP).

With an implementation timetable now established, covered contractors should begin the process of mapping their existing occupational codes and reasonable recruitment areas from the 2006-2010 Tabulation to this latest EEO Tabulation.
