Recently, the Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) began publishing financial settlement agreements resulting from OFCCP complaint investigations.
Although OFCCP’s primary enforcement tool is the compliance evaluation or audit, the agency also has the authority to accept and investigate complaints from individuals who believe they have been discriminated against under any of the laws and regulations OFCCP enforces. Because complaint investigations historically have represented a very small percentage of the agency’s overall enforcement activity, they have remained largely in the shadows as compared to compliance audits.
With OFCCP now electing to be more transparent regarding its complaint investigation activity and results, however, we thought it would be a good time to present an overview of the process and take a closer look at OFCCP’s complaint investigation database and the information it holds.
