The Equal Employment Opportunity Commission (EEOC) announced a settlement recently in a class-based discrimination lawsuit brought by the agency against an employer under the 2008 Genetic Information Nondiscrimination Act (GINA). EEOC’s lawsuit, filed in federal court, accused BNV Home Care Agency, Inc., of unlawfully requesting genetic information from applicants and employees.

The settlement, in the form of a consent decree, provides for $125,000 in monetary relief to be paid to an undisclosed number of applicants and employees whom the EEOC claimed were asked to provide genetic information in the form of family medical history on an “employee health assessment” form in violation of GINA’s requirements.
