President Trump’s Executive Order (E.O.) 13769 imposing a travel ban on nationals from seven countries and ordering a suspension of refugee programs has drawn widespread attention and criticism. While questions of whether the president exceeded his legal authority in issuing the E.O. and whether it should be put on hold pending a resolution on the merits remain to be answered, we thought it would be helpful to provide a high-level summary of the E.O. and related litigation. To that end, we have prepared an overview of both the E.O. and concerns about the E.O.’s impact that have been expressed in a friend-of-the-court brief filed by nearly 100 major U.S. employers.
A copy of Executive Order 13769 is available here and a copy of the amicus curiae brief filed by 97 employers can be found here.
