CWC has filed comments with the Office of Management and Budget, supporting a recent request by OFCCP to formally revise two of the forms it uses to process employment discrimination allegations against federal contractors. The forms are the CC-4 (the Complaint of Employment Discrimination Involving a Federal Contractor or Subcontractor) and the CC-390 (Pre-Complaint Inquiry for Employment Discrimination Involving a Federal Contractor or Subcontractor).

The changes reflect the rescission of Executive Order 11246 and confirm that applicants and employees may no longer file complaints based on race, color, religion, sex, sexual orientation, gender identity, or national origin, or allege that they were retaliated against for asking about, discussing, or disclosing compensation. OMB approved the revisions on an emergency basis last July, clearing the way for OFCCP to resume disability- and veteran-related complaint investigations under Section 503 of the Rehabilitation Act and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act (VEVRAA).

CWC’s comments acknowledge that the revisions will provide clarity to applicants, employees, and contractors in the wake of E.O. 11246’s rescission. OMB’s approval at this point is mostly a formality.
