Brittany Panuccio was sworn in as a Commissioner on the Equal Employment Opportunity Commission October 27. This restores the agency’s quorum and gives it a Republican majority for the first time since 2022.

Panuccio will serve through 2029, joining Acting Chair Andrea Lucas (Republican) and Commissioner Kalpana Kotagal (Democrat) on the Commission. With two vacancies remaining, the Commission now holds a Republican majority and is positioned to advance the Trump Administration’s policy and enforcement agenda.

Key priorities likely to move forward include:

  • Narrowing the scope of the Pregnant Workers Fairness Act regulations, such as those related to abortion coverage;
  • Revising guidance about discrimination based on sexual orientation and gender identity;
  • Updating the agency’s Strategic Plan and Strategic Enforcement Plan; and
  • Increasing litigation and friend-of-the court briefs supporting Administration priorities, such as challenging DEI programs and anti-American discrimination and bolstering accommodation of religious practices and observances.

The EEOC also may consider revising the Uniform Guidelines on Employee Selection Procedures and the EEO-1 reporting requirements.

The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, will discuss EEOC priorities at its Workplace Policy Conference on March 18-19, 2026. CWC members can read more here.
