The Senate has joined the House of Representatives in passing a resolution under the rarely invoked Congressional Review Act (CRA) to disapprove the regulations implementing President Obama’s 2014 Executive Order (E.O.) 13673, the Fair Pay and Safe Workplaces or “blacklisting” E.O.
The disapproval resolution now goes to the White House, which has issued a statement indicating that President Trump intends to sign it, effectively repealing the blacklisting rule across the board. While most major portions of the rule were already on hold as the result of a federal court injunction issued late last year, the rule’s so-called paycheck transparency provisions did go into effect for contracts entered into after January 1, 2017. Federal contractors will no longer be obligated to comply with these paycheck transparency requirements once President Trump signs the disapproval resolution into law.
