The Office of Federal Contract Compliance Programs has asked the Office of Management and Budget for emergency authorization to eliminate Voluntary Self-Identification of Disability Form (Form CC-305). Federal contractors currently use Form CC-305 to invite applicants and employees to voluntarily report their disability status.
OFCCP’s request follows a recent rulemaking through which it modified its regulations implementing the nondiscrimination and affirmative action requirements under Section 503 of the Rehabilitation Act. The final rule, which takes effect September 21, eliminates the requirement for employers to: (1) solicit disability status from applicants or employees; (2) prepare a disability utilization analysis; and (3) use disability applicant and hire data to assess their outreach efforts.
Rescission of the Section 503 self-identification requirements, along with OMB’s expected rescission of Form CC-305, means that as of September 21, federal contractors should no longer use Form CC-305 to solicit disability status from applicants and employees. Moving forward, the Americans with Disabilities Act and the Equal Employment Opportunity Commission’s implementing regulations will govern any disability inquiries.
