The White House Office of Management and Budget has approved for three years OFCCP’s request to change its complaint forms for processing disability and veteran employment discrimination allegations against federal contractors. The Office of Federal Contract Compliance Programs had asked permission to formally revise its Complaint of Employment Discrimination Involving a Federal Contractor or Subcontractor (Form CC-4) and Pre-Complaint Inquiry for Employment Discrimination Involving a Federal Contractor or Subcontractor (Form CC-390).

The new forms, which OMB approved through February 2029, reflect the rescission of E.O. 11246 and confirm that applicants and employees may no longer file complaints based on race, color, religion, sex, sexual orientation, gender identity, or national origin, or allege that they were retaliated against for asking about, discussing, or disclosing compensation.

OMB had already approved the revisions on an emergency basis last July, clearing the way for OFCCP to resume investigating disability- and veteran-related complaints under Section 503 of the Rehabilitation Act and Section 4212 of the Vietnam Era Veterans’ Readjustment Assistance Act. OMB’s approval reaffirms that OFCCP will continue to process these complaints.
